1. No purchase necessary. The contest begins on May 20th, 2010 at 12:00:01 a.m. Pacific Time “PT”) and ends on October 31st, 2010 at 11:59:59 p.m. PT. To enter the contest, go to www.raiseyourhand.com/contest and use the Rhythmixer in accordance with Rule 2 to enter contest. There is a limit of one entry per person and per email address through www.raiseyourhand.com; however, after submitting their entry each entrant will be provided a unique code which they can use to obtain one (1) additional entry on the Raise Your Hand Facebook fan page www.facebook.com/ryhmovement

1. ELIGIBILITY

To be eligible for this Contest, an individual must: (i) be a legal resident of British Columbia and (ii) have reached nineteen years of age at the time of entry. Employees, representatives and agents of WorkSafeBC (the "Sponsor"), the Sponsor’s parents, affiliates, subsidiaries, its advertising or promotional agencies and any entity involved in the production, implementation, administration or fulfillment of the Contest and members of the immediate family or household of any of the above, are not eligible to participate in the Contest. In these Rules, "immediate family" means husband or wife, mother, father, brothers, sisters, sons and daughters.

Minors: If you are under the age of nineteen, then by entering you are confirming that you have obtained your parent/legal guardian’s consent to your entering the Contest.

The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. Facebook is completely released of all liability by each entrant (and, if the entrant is under the age of majority in his/her province/territory of residence, his/her parent or legal guardian) for this Contest. Any questions, comments or complaints regarding the Contest must be directed to Sponsor or the Contest Administrator and not Facebook.

2. HOW TO ENTER

The Contest begins at 12:00 AM Pacific Time ("PT") on May 20, 2010 and closes at 11:59 PM PT on October 31, 2010 (the "Entry Period"). No purchase is necessary to enter the Contest. To enter the contest, entrants are required to visit www.raiseyourhand.com/contest and use the Rhythmixer, to:

  • Create your own mix of rhythms and rights
  • Choose from the instruments to build your own beat
  • Then add spoken verses by clicking the vocal pad
  • When ready, press ‘record’ to capture up to 2 minutes of your mix
  • Save your mix.

Once you have saved your mix, you will be provided an online entry form for contest entry. To enter, complete the online form, including your name, telephone number, email address and city/province, and click where directed to submit the entry form. After submitting an entry using the steps above, each entrant will receive one (1) entry in the contest and be provided a unique code which they can use to obtain one (1) additional entry on the Raise Your Hand Facebook fan page www.facebook.com/ryhmovement

Limit of one entry per person and per email address through www.raiseyourhand.com and limit one entry per person and per email address through the RaiseYourHand Facebook fan page during the Entry Period. Any additional entries will be disqualified. All entries must be submitted no later than the end of the Entry Period. All entries become the property of WorkSafeBC and none will be returned. Illegible, incomplete, late, or garbled entries will be disqualified. No entries will be accepted by any other means, including but not limited to email.

By entering the Contest and using the Rhythmixer, each entrant: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use their song, in whole or in part, for advertising or promoting the Contest or for any other reason, in any medium, along with their first name; (ii) waives all moral rights in and to his/her song in favour of the Sponsor; and (iii) agrees to release and hold harmless the Sponsor and its agents, employees, directors, successors, and assigns (collectively, the “Releasees”) against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action related to the song. For greater certainty, the Sponsor reserves the right, in its sole discretion, to: (i) disqualify any song; (ii) modify, edit or remove any song from any website; and/or (iii) request an entrant to modify or edit his or her song; if a complaint is received with respect to the song, or for any other reason.

3. WINNER SELECTIONS

GRAND PRIZE: On or about November 2nd, 2010 in Vancouver, British Columbia at #160 - 1020 Mainland St., a random draw will be conducted, by a representative of WorkSafeBC, to select one (1) entry for the Grand Prize. All entries received throughout the Entry Period will be included in the draw. Odds of being selected for the grand prize are dependent upon the number of eligible entries received throughout the Entry Period.

MONTHLY PRIZES: On or around the second day of each of the months of July, August, September and October, 2010, a random draw will be conducted, by a representative of WorkSafe BC, to select one (1) entry from all entries received by 11:59 pm on the last day of the previous month (“Monthly Entry Deadline”), for a monthly prize. All entries (except those already selected for a monthly prize) will be eligible for all draws for which the Monthly Entry Deadline occurs after they are received. Odds of being selected for a monthly prize are dependent upon the number of eligible entries received prior to the Monthly Entry Deadline for that month’s draw.

4. PRIZES

a. There are four (4) monthly prize packages available to be won, each consisting of:

i. One Xbox 360 console

ii. One DJ Hero game

The approximate value of each prize is $470.

There is one (1) grand prize package, available to be won, consisting of

iii. One Apple 16G iPad with WiFi

iv. One $300 iTunes gift card(s)

The approximate value of the grand prize is $900. Prizes must be accepted as awarded. Delivery of prizes will be coordinated with the winners after each selected entrant has been successfully contacted, complied with all contest rules and requirements and been declared a winner. Prizes are subject to availability and exact details of the prizes to be determined by the Sponsor in its sole discretion. Sponsor reserves the right to substitute a prize of equivalent value if a prize listed above is unavailable for any reason.

5. CONDITIONS OF WINNING

a. Before being declared a winner of any prize in this contest, each selected entrant will be required to answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question during a pre-arranged telephone call, and to comply with all of these rules (“Contest Rules”). The prizes are not transferable or convertible to cash and must be accepted as awarded.

b. Selected entrants will be notified by phone and must respond within forty-eight hours of notification. Upon notification, each selected entrant must respond by telephone to the contact number provided in the notification and the selected entrant’s (or their parent/legal guardian if the selected entrant is under the age of nineteen years) response must be received by Sponsors within forty-eight hours of such notification. If a selected entrant does not respond in accordance with the Contest Rules or the selected entrant is unwilling or unable to comply with the Contest Rules or has not obtained the consent of their parent/legal guardian, he/she will be disqualified and will not receive a prize and another entrant will be selected for that prize. Sponsor is not responsible for the failure for any reason whatsoever of selected entrant to receive notification or for Sponsor to receive selected entrant's response.

c. Before being declared a winner, each selected entrant (or their parent/legal guardian if the selected entrant is under the age of nineteen years) will be required to sign a Declaration and Release form confirming compliance with the Contest Rules and acceptance of the prize as offered and (i) releasing the Sponsor and its parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers, agents and sponsors from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest or participating in any prize-related activity or the acceptance, use or misuse of any prize, including without limitation costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from and (ii) granting Sponsor and its representatives and agents the unrestricted rights, in their collective or individual discretion, to publish without any further compensation the name, picture, portrait, likeness, voice and Rhythmixer song of that entrant for advertising and promotional purposes. The Declaration and Release must be returned within five business days of the notification date indicated on the documents or the selected entrant will be disqualified and the prize forfeited.

6. INDEMNIFICATION BY PARTICIPANTS

By entering the Contest, Entrant: (a) releases and holds harmless Sponsor and its directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Contest, or participating in any prize-related activity; and (b) agrees to fully indemnify Sponsor and its directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any and all claims by third parties without limitation.

7. CONDUCT

By entering this Contest, Entrants agree to be bound by these Contest Rules, which will be posted at the Contest Website www.raiseyourhand.com/contest throughout the Contest. Entrants further agree to be bound by the decisions of the judges, which shall be final and binding in all respects. Sponsors reserve the right, in their sole discretion, to disqualify any Entrant it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Contest (b) violating the Contest Rules; (c) acting in an unsportsman-like or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

8. LIMITATION OF LIABILITY

Sponsor assumes no responsibility or liability for lost, late, misdirected or incomplete entries, notifications, responses, replies, or any agreement and release documents or for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an entry). Sponsor is not responsible for any incorrect or inaccurate information, whether caused by entrants or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any injury or damage to entrants or to any computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right at their sole discretion to cancel, terminate, modify or suspend the Contest.

9. PRIVACY

By entering the contest, each entrant agrees to the Sponsors' use of entrant's personal information for the purposes of administering this Contest. Personal information collected in connection with this contest will be handled in accordance with the Sponsor’s privacy policy located at www.raiseyourhand.com/home/privacy

10. LAWS

These are the official Contest Rules. This Contest is subject to all federal, provincial and municipal laws and regulations. These Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor.

11. TERMINATION

Sponsor reserves the right to amend or terminate all or any portion of this Contest at any time for any reason without prior notice.
